The extent of, and the limits to, the definition of ‘Secured Property’

Orla McCoy, Tom Gardner, Dom McGreal and Anna Schwartz of Gilbert + Tobin summarise a recent case in which the court considered the meaning of ‘Secured Property ‘as defined in a specific security deed and the extent to which phrases such as ‘…in respect of’ could expand the types of collateral the subject of that defined term, finding that such expressions were simply descriptive and related to the collateral expressly described, and did not expand the scope of the secured property beyond that limited description.
