High Court clarifies repayment-method clauses: lenders can accept discharge and still claim damages – Shao v Crown Global Capital [2025] HCA 43

Trevor Withane of Ironbridge Legal looks at a recent High Court of Australia decision holding that a repayment clause can both discharge a debt and impose an independent obligation as to how payment must be made, allowing a lender to accept repayment yet still claim damages for non-compliance, and confirming that one co-lender may sue alone and that sequential enforcement actions do not constitute an abuse of process.
