High Court willing to test pooling orders

Alicia Salvo and Brooke Egan of Corrs note that liquidators historically have faced an uphill battle in convincing a court to allow the assets of separate legal entities to be pooled to satisfy creditors of the broader group but note that the High Court has recently granted a special leave application which hopefully will provide clarification as to the availability of pooling orders and the property of liquidated companies which may be combined under a pooling order.
