Leon Zwier of Arnold Bloch Leibler argues that Australia’s restructuring laws must shift from a punitive to a rehabilitative framework by expanding the use of schemes of arrangement, introducing automatic moratoriums, limiting voting rights to economically interested creditors, and lowering approval thresholds, to better preserve value and attract global capital in an era of rising insolvencies.
