PGP Group - Case Update

Daniel Walley, Adam Colley and Mahala Hazell of PwC, the joint administrators of PGP Group, have obtained an order clarifying the terms on which the company’s employees are to be paid during the administration. The Waterfall, New South Wales-based provider of seasonal labour services for horticulture, cotton and general farming, entered voluntary administration on 30 October. A couple of weeks after their appointment, the joint administrators advised creditors that they would be seeking an order permitting them to pay employees on the same terms in place prior to their appointment, and limiting their liability to the assets of the company with respect to certain debts and liabilities incurred in connection with the ongoing trading of the company, being: (a) agreements with employees entered into pre-appointment; and (b) a funding arrangement entered into with Scottish Pacific Business Finance Pty Ltd to provide funding during the administration. The Court made the order on 16 November.
