Queensland Court of Appeal restores the reach of all-assets security

Tom Schinckel, Becci Cartoon and Pinchao Yao of Corrs analyse a Queensland Court of Appeal decision confirming that an all-assets security interest extends to after-acquired property arising from a mere expectancy, including contingent tax refunds, and takes priority over a subsequent assignment of that property, while also establishing that a deed of company arrangement releasing the underlying secured debt does not extinguish the creditor’s security rights, even over property acquired after the deed is effectuated.
