Queensland Nickel - Case Update

The Supreme Court of Queensland has rejected a request by the joint administrators of Queensland Nickel to have their remuneration fixed at $1.3 million without an oral hearing of the matter.

The Court emphasised that it will generally be inappropriate to use this procedure where the application is factually or legally complex, and that “complexity, like beauty, is in the eye of the beholder and lawyers who have a deep understanding of a matter can sometimes not appreciate that their understanding of the case will not easily be conveyed without the benefit of an oral hearing”.

The Court found that, although relevant parties had been served and no objections had been raised, this was not a cut and dried case, and concluded that it was not an appropriate one to be decided without the benefit of an oral hearing.
