The Summary Nature of Proof Adjudications: Lessons from Mercon Group

Masi Zaki of Bird & Bird explains that the NSW Supreme Court recently confirmed that administrators adjudicating proofs of debt in voluntary administrations perform a summary task, requiring only a genuine and reasonable “just estimate” based on the material provided, and may admit disputed, contingent or inadequately supported construction defect claims at a nominal value, rather than apply arbitrary discounts or conduct detailed investigations.
